The criminal justice system is comprised of three independent sections working together. The police investigate criminal activity and collect evidence for use at trial/ The Prosecutor (District Attorney, State’s Attorney, Commonwealth Attorney) evaluate the evidence and present it in a court. The Court protects the interests of both sides and explains the law to a trier of fact (judge or jury.) The trier of fact then determines, based on the evidence and testimony and determines the guilt or incense of the Defendant.
The case of The People of New York versus Donald J. Trump failed to meet the standard for each. The standard is that all operate without bias and protect the rights of the Defendant. The Police had no involvement in the case. The Prosecutor campaigned on his intent to Get” Mr. trump. The Court was a travesty as itL (1) Appointed a judge whose name did not appear on the list of twenty-four judges eligible to oversee the case; (2) The same judge oversaw three cases involving Mr. Trump or a related defendant within the past year; (3)The jury was chosen from a pool who not only knew of the defendant, but ninety-five present had voted against him in his 2016 and 2020 runs for President. With a limited number of pre-emptive challenges (the removal of a juror without a specific reason, the choice of a fair and impartial jury was hindered.
To further complicate the situation, The judge issued multiple rulings that confounded the top constitutional attorneys in the country. Jonathan Turley teaches constitutional law at the prestigious Georgetown University Law School. Alan Dershowitz retired af decades of teaching law at Harvard Law School. Both of these experts expressed concern about the rulings in this case, stating that they went against established law.
If Trump did not have the resources to spent millions of dollars for legal fees, he would not have survived this onslaught/ Whether r not he is guilty or innocent of these charges Had this happened to anyone of lesser stature, they would be currently sitting in a cell awaiting transfer to a satte penitentiary.
